By accessing and using any part of Sigma Ultrasound Pty Ltd ACN 696 561 234 website, you agree to comply with the following terms and conditions.
These terms govern your use of the website and also further govern the provision of any goods and services (“Services”) provided by Sigma (“we/our/us”) to you. If you do not agree with these terms, please refrain from using the website or requesting any of our services.

Our website and all materials within our physical clinics / premises is protected by copyright and intellectual property laws. Such material includes, but is not limited to the content, design, layout and images. All rights are reserved. You may not reproduce, distribute, modify, or transmit any part of this website or our branding or materials without our express prior consent in writing.
The information provided on our website is for general information purposes only. It does not constitute professional advice or replace individualised treatment which may be tailored to your specific circumstances and which is to be determined in our clinic.
We strive to provide accurate and up-to-date information, but we do not guarantee the completeness or accuracy of the content herein. Your use of any information on this website is at your own risk in all respects.
4. Your relationship with us
We provide the Services requested of us in accordance with any medical referral forwarded by you or on your behalf. Your principal health practitioner remains your referring medical practitioner (or such other practitioner you are receiving medical services from), and any relationship with us is limited to the diagnostic or imaging Services provided to you, and does not constitute an ongoing medical care relationship outside of such Services.
5. Payment policy and rebates
Payment for Services rendered by us is required to be made in full on the day of your appointment, or at a prior date.
Payment may be made by EFT, Visa/Mastercard of Cash at our clinic, payable over the phone or otherwise in person at our clinic.
Costs vary by procedure, and an estimate shall be provided at booking, noting final fees may change upon review, to be advised by us.
Subject to eligibility, some Services are bulk-billed, with a Medicare rebate processed for patients holding a valid Medicare card. Note: obstetric or specialist ultrasounds may incur out-of-pocket costs.
Should payment not be made in full in accordance with these terms, we reserve the right to pursue any amount owing as a debt due and payable from you, and to levy interest on any amount outstanding at a rate of 10% per annum, plus any costs incurred in pursuing the amounts owed (such as collection and/or legal costs) payable on an indemnity basis.
6. Modifications to price and/or Services
Prices for our Services are subject to change without notice.
We reserve the right at any time to modify or discontinue our Services (or any part thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Services.
7. Appointment book and referrals
For elective ultrasounds, is satisfactory images cannot be obtained, a follow-up appointment can be arranged. If images cannot be captured after a second appointment, a refund may be offered. Please note there are no refunds applicable for diagnostic ultrasounds.
Services associated with the determination of a baby’s gender are not guaranteed to be 100% accurate, and we incur no liability or responsibility for any error in this regard.
Elective scans, including baby bonding and 3D/4D/5D imaging, are non-diagnostic and do not include any medical advice or opinions. Any elective scans do not replace any medical imaging which may be recommended or required by your dedicated medical practitioner.
Services may be refused in our absolute discretion at any time, such as, for example, if the you are unfit to provide consent (e.g. cognitive impairment, intoxication), if you are aggressive or inappropriate, or you are a minor who attends our practice without a consenting adult guardian.
10. Data and Privacy
These Terms shall be read in conjunction with our Privacy Policy. Any medical imaging, reports, patient information and related data is stored by us via our various software providers from time to time (including but not limited to PACS, Bookeo and Visage, or any subsequent or similar software providers utilised by us for the purpose of delivering the Services). All data shall be retained in accordance with the terms of our Privacy Policy and our obligations at law.
We collect and process personal data in accordance with our obligations under the Privacy Act 1988 (Cth). Any personal information you provide is used solely for the purpose of providing you with Services and improving our website's functionality.
Our Privacy Policy is available on our website, and a hard copy can be provided upon written request.
Our website may contain links to third-party websites for your convenience or reference. These websites are outside of our control, and we are not responsible for their content, privacy practices, or any consequences that may arise from accessing them. We encourage you to review the terms and privacy policies of any third-party websites you visit.
Sigma Ultrasound Pty Ltd, its employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of your use of, or inability to use, our website, or in respect of the Services provided. This includes any damages resulting from reliance on the information presented on the website, any interruptions or errors in its operation, or any other information provided by us generally in respect of the Services.
13. Severability and waiver
If any part of these Terms is deemed to be invalid or unenforceable by any Court or tribunal, such invalid or unenforceable term shall be severed and the remaining provisions of these Terms shall continue in full force and effect.
Furthermore, should we fail to enforce any provision of these Terms, such failure to enforce shall not constitute a waiver of such terms or our rights.

Should you have any dispute with us in respect of the Services or our website, or any matters concerning these Terms, you agree that you will attempt to resolve such dispute before commencement of any formal proceedings or complaint by contacting us at info@sigmaultrasound.com.au.
These terms and conditions are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute between us and any party arising from the use of our website, or in respect of Services provided by us, shall be subject to the non-exclusive jurisdiction of the Courts/tribunals domiciled within the State of Queensland and/or the Commonwealth of Australia.
